Terms of Service

Thank you for using zhko (the "Service"). These Terms of Service ("Terms") are a contract between you and zhko ("zhko," "we," "us," or "our"). By creating an account, subscribing, or using the Service, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not use the Service.

1) Who may use the Service

  • Minimum age. You must be at least 13 years old to use zhko. If you live in the EEA/UK, you must be at or above your country's digital age of consent (13-16) or have verifiable parental/guardian consent.
  • Schools/teachers. If you use zhko with students or on behalf of a school, you represent you have all required parental consents and that you will use our Data Processing Addendum (DPA) upon request.

2) Your account

You are responsible for your account credentials and for everything done through your account. Keep your password secure. Tell us immediately at zhkodotapp@gmail.com if you suspect unauthorized use.

3) Subscriptions, billing, cancellations, refunds

  • Plans & auto-renewal. Some features require a paid subscription ("Pro"). Pro plans auto-renew until canceled. We'll charge the payment method you provide at the then-current price.
  • Free trials. If we offer a trial, you'll be charged when the trial ends unless you cancel beforehand.
  • Cancel anytime. You can cancel from Settings → Billing. Your Pro features remain until the end of the paid period; then your plan downgrades to free.
  • Price changes. We may change prices or features on renewal. We'll notify you in advance and give you a chance to cancel.
  • Refunds.
  • US/Rest of world: Refunds are discretionary unless required by law. If something isn't working, contact zhkodotapp@gmail.com within 14 days of purchase and we'll do our best to help.
  • EEA/UK cooling-off: If you are a consumer in the EEA/UK, you may withdraw from a new Pro purchase within 14 days of subscribing. By starting Pro features immediately, you request immediate performance and acknowledge you may owe a proportional amount or lose the right to withdraw once the service is fully provided during the cooling-off period.

Taxes. Prices may exclude taxes (e.g., VAT, GST). We'll collect them where required.

4) License and permitted use

We grant you a limited, personal, non-exclusive, non-transferable license to access and use the Service for language learning and research, subject to these Terms.

You agree not to:

  • copy, scrape at scale, or bulk export content except as permitted in §7 (Open-licensed resources) or via an official export tool;
  • reverse-engineer or circumvent access controls;
  • use the Service to build or train a competing dictionary, SRS, or language-learning product;
  • upload unlawful content or violate others' rights;
  • use bots to create accounts or overload our systems.

We may offer beta/experimental features; they're provided as-is and may change or end at any time.

5) Your content & permissions

Your content. You may upload or create content (e.g., notes, custom decks, example sentences, recordings) ("User Content"). You keep ownership of User Content.

License to operate the Service. You grant us a worldwide, non-exclusive, royalty-free license to host, process, adapt (e.g., tokenize, segment, transcribe), display, and distribute your User Content only as needed to provide and improve the Service to you and other users you share with. This license ends when your content is deleted from our systems (subject to routine backups and legal holds).

Model-training choice. We do not use your private User Content to train models by default. You may opt-in (or opt-out) at any time in Settings → Privacy. Aggregated analytics that do not identify you may be used to improve features.

Public sharing. If you publish or share content publicly (e.g., community decks), you grant other users a license to use that content consistent with any license you set (e.g., CC licenses). You are responsible for choosing a license and for having rights to share.

Feedback. If you send ideas or suggestions, you grant us a free, irrevocable license to use them without restriction.

6) Our content & IP

The Service, including software, design, and our original datasets and documentation ("zhko Content"), is owned by us or our licensors and protected by IP laws. Except for the license in §4, no rights are granted. Do not remove notices or credits.

7) Third-party & open-licensed resources

zhko integrates linguistic resources that may be licensed under Creative Commons or similar licenses (for example, CC-BY, CC-BY-SA, CC0). We provide acknowledgments in our Credits page and, where required, display attribution in-product.

Your responsibilities when exporting or reusing data:

  • If you export or reuse content derived from resources licensed under CC-BY, you must provide appropriate attribution as required by that license.
  • If you export or reuse content derived from CC-BY-SA resources (e.g., portions of dictionary data), your derivative database must be shared under the same license. Our Terms do not override those open licenses.
  • Some sentence corpora include author-by-author attribution requirements. Where we provide per-item credits or links, you must preserve them when you redistribute.

If a license requires it, we'll make available a reasonable export of the share-alike dataset portion. For questions about attribution or exports, contact zhkodotapp@gmail.com.

8) Educational and organizational use

If you are an institution or company processing personal data with zhko, our DPA is available upon request at zhkodotapp@gmail.com. You must ensure a lawful basis and obtain all required consents for learners.

9) Privacy & data security

Your use of the Service is also governed by our Privacy Policy, which explains what we collect, why, and how to exercise your rights. We use industry-standard safeguards and reputable cloud providers. No method of transmission is 100% secure; use the Service at your own risk.

10) Copyright & takedown (DMCA / EU/UK notice)

We respect IP rights. If you believe content infringes your copyright:

  • US (DMCA) agent: zhkodotapp@gmail.com. Your notice must include the elements required by 17 U.S.C. §512(c)(3).
  • EEA/UK: Send a notice to zhkodotapp@gmail.com with details sufficient for us to locate and assess the material.

We may remove content and terminate repeat infringers in appropriate circumstances.

11) Third-party services

The Service may integrate third-party services (e.g., text-to-speech or analytics). Your use of those features may be subject to the third parties' terms. We aren't responsible for third-party services.

12) Service changes

We may change, suspend, or discontinue features with reasonable notice where practicable. If we discontinue a paid feature during your paid period, we'll provide a pro-rata credit or refund.

13) Disclaimers

The Service provides educational information and approximate translations/pronunciations. It may contain errors. We do not guarantee accuracy, results, or availability. The Service is provided "AS IS" to the fullest extent permitted by law.

14) Limitation of liability

To the maximum extent permitted by law, we won't be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from or related to the Service or these Terms.

Where liability cannot be excluded, our total liability for all claims in a 12-month period is limited to the amounts you paid to us for the Service in that period, or USD $50 if you used the free plan.

Consumer rights that cannot be waived by law are not affected.

15) Indemnity

You agree to indemnify us for third-party claims arising from your unlawful use of the Service, your User Content, or your violation of these Terms or others' rights.

16) Governing law & dispute resolution

A. United States & Canada

These Terms are governed by the laws of New York, USA, excluding its conflicts rules. Binding arbitration & class-action waiver: Except for small-claims court, any dispute will be resolved by individual arbitration under [AAA/JAMS] Consumer Rules. No class actions or mass arbitrations. You may opt out within 30 days of first accepting these Terms by emailing zhkodotapp@gmail.com with your account email and a statement that you opt out. This section does not apply where prohibited by law.

B. EEA, UK, and Switzerland

You may bring claims in your local courts under your local mandatory consumer law. These Terms are governed by English law, but you also enjoy the protection of mandatory laws of your country of residence. No mandatory arbitration applies.

C. Rest of world

These Terms are governed by the laws of New York, USA. Courts located in New York, USA shall have exclusive jurisdiction, subject to any non-waivable consumer protections in your country.

17) Termination

You may stop using the Service at any time. We may suspend or terminate your access with notice if you materially or repeatedly breach these Terms or if required by law. On termination, the licenses you granted in §5 for operation end, but sections that by nature survive (e.g., §7, §13-§16) continue.

18) Changes to these Terms

When we change these Terms, we'll post the update and revise the "Last updated" date. Material changes will be notified in-app or by email. If you keep using the Service after the effective date, you accept the new Terms.

20) Definitions

  • "Service" means the zhko websites, apps, and related features.
  • "User Content" means content you upload, input, or create in the Service.
  • "zhko Content" means software, UI, original datasets, documentation, and other content we own or license (excluding User Content and third-party open-licensed resources).
